TERMS OF SERVICE

IMPORTANT NOTICE: PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN A BINDING ARBITRATION PROVISION AND CLASS ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS.

1. ACCEPTANCE OF TERMS AND PLATFORM ARCHITECTURE

These Terms of Service ("Terms") constitute a legally binding License Agreement between you ("User" or "You") and Regnum Games Inc., a Wyoming corporation ("Company", "we", "us", or "our").

The Champions of Regnum game platform constitutes a virtual "client-server" architecture accessed via the Internet. To participate, you must: (a) register a user account; (b) download the software client; (c) install the client; and (d) connect via the Internet to our servers. These Terms govern your access to the game, the client, the website (www.championsofregnum.com), our official community channels (including but not limited to our official Discord server, Reddit, Instagram, Facebook, and Bluesky accounts), and all related services (collectively, the "Service").

BY DOWNLOADING, INSTALLING, OR USING THE PLATFORM, YOU AGREE TO COMPLY WITH THESE TERMS AND ACKNOWLEDGE OUR PRIVACY POLICY. If you do not agree, you must abstain from downloading or using the Service.

2. ELIGIBILITY AND LEGAL CAPACITY

The Service is intended for persons eighteen (18) years of age or older. If you are under 18 (or the legal age of majority in your jurisdiction), you may only participate with the authorization and active assistance of your parent or legal guardian, who accepts full responsibility for your actions.

Serious Misconduct: Falsely declaring your age or falsely claiming parental authorization constitutes a material breach of these Terms and will result in immediate Account termination.

3. ACCOUNT REGISTRATION AND CUSTODY

3.1 Truthful Information: Any information provided during registration is considered an affidavit of truth. You are responsible for keeping this information updated.

3.2 Account Custody: Participation in the game is strictly personal. You may not share your username and password with any third party. You must notify us immediately if you suspect your account has been compromised. In the event of a lost password, the Company reserves the right to request real identity verification before issuing a new one.

3.3 Absolute Security: While the Company uses advanced technology to protect your data, no system is infallible. By registering, you acknowledge that the Company does not guarantee absolute inviolability of its systems.

3.4 Privacy and Data Protection: Your privacy is important to us. The collection, use, storage, and cross-border transfer of your personal data (including information provided during registration) are governed by our Privacy Policy. By creating an Account and using the Service, you acknowledge the data processing practices described in the Privacy Policy.

4. NOTICES, COMMUNICATIONS, AND SUPPORT

4.1 Support Tickets: The Company offers a support system for claims via "tickets" at https://regnumgames.zendesk.com or support@championsofregnum.com. The Company will review each case and attempt to find a solution; however, no fixed compromises, time frames, or guaranteed resolutions are provided.

4.2 Notices: Communications sent to the e-mail address registered to your Account, as well as in-game notices and website announcements, will be considered fully valid and legally effective.

5. SOFTWARE CLIENT, LICENSE, AND MINIMUM REQUIREMENTS

5.1 License Grant: The Company grants you a temporary, limited, non-transferable, and non-exclusive license to download, install, and execute the Client solely for your personal entertainment.

5.2 Minimum Requirements: For the adequate functioning of the Client, it is required that your equipment meets the following minimum software and hardware characteristics:

• Windows XP Operating System Service Pack 2 or superior
• 1 GB of available RAM memory
• Athlon X2 Processor or superior (AMD) or Intel Core 2 Duo or superior (Intel)
• Internet connection of 256 Kbps or superior
• 9 GB free space on the hard disk
• Video card GeForce3 or superior (Nvidia) / Radeon 9800 or superior (AMD)

You acknowledge that online games evolve. The Company reserves the right to modify or increase the minimum system requirements to play Champions of Regnum at any time without prior notice. You are solely responsible for acquiring, configuring, and maintaining the necessary hardware and internet connection to use the Service.

5.3 Connection Interruptions: Elements of the internet are beyond our control. The Company accepts no liability for connection failures, lag, or packet loss caused by internet service providers, third-party infrastructure, or force majeure.

6. FREE SERVICES, PREMIUM SERVICES, AND VIRTUAL CURRENCY (XIMERIN)

6.1 Free and Premium Services: The game offers free access as well as "Premium Services" (e.g., experience bonuses, health/mana potions, repair tools, cosmetic armors/hairdos, extra characters).

6.2 XIMERIN (Virtual Currency): Premium Services are accessed using a virtual currency called "XIMERIN." XIMERIN is a licensed virtual good, not real money. XIMERIN has no real-world monetary value, cannot be exchanged for cash, and cannot be sold or transferred outside the game.

6.3 Refund Policy: All purchases of XIMERIN, Premium Services, and other digital content are subject to our Refund Policy, which is incorporated into these Terms by reference. Digital purchases are generally final once delivered or used; however, unused virtual currency or items may be eligible for a refund if requested within fourteen (14) days of purchase, or under specific circumstances as detailed in the Refund Policy.

6.4 Payment Processors and Platforms: Payments may be processed by third-party providers (e.g., Stripe, PayPal, Xsolla, Steam, Apple, Google). Using these providers does not change your rights under our Refund Policy. Unless your purchase was made directly through a platform that strictly controls its own refunds (such as Steam, Apple, or Google), refund requests should be submitted directly to us at support@championsofregnum.com.

6.5 Fraud and Payment Abuse: If a payment is reversed, refunded, charged back, or identified as unauthorized, we reserve the right to remove the related XIMERIN or Premium Services from your Account. Abusing the chargeback system?such as willfully initiating a chargeback after consuming a Premium Service, or falsely claiming an error?constitutes a material breach of these Terms. We reserve the right to suspend or close accounts involved in payment fraud or abuse, subject to applicable law.

7. USER CONDUCT AND PROHIBITED ACTIVITIES

You agree to use the Service in accordance with good morals, these Terms, and our Code of Conduct, which is incorporated into these Terms by reference. We take abuse and harassment very seriously. The following actions are strictly FORBIDDEN USE:

• Harassment and Toxicity: Engaging in harassment, hate speech, threats, deliberate intimidation, doxxing (publishing private communications), stalking, or any behavior that violates our Code of Conduct.
• Cross-Platform Conduct: Your conduct on our official third-party community platforms (e.g., Discord, Reddit, Bluesky) is subject to both these Terms and the Code of Conduct. We reserve the right to suspend or terminate your in-game Account for severe misconduct occurring on our official third-party community channels.
• Cheating/Hacking: Using bots, automation software, hacks, non-authorized mods, or exploiting any bugs/glitches for unearned prosperity.
• Real Money Trading (RMT): Exploiting the game for commercial objectives, including selling XIMERIN, items, accounts, or performing services (e.g., power-leveling) for real-world currency outside the game.
• Server Interference: Facilitating or creating non-authorized connections (e.g., unauthorized private servers, emulators) or attacking our servers (DDoS).
• Impersonation: Falsely claiming affiliation with the Company, representing yourself as a Game Master (GM), admin, or host.
• Disruptive Behavior: Negatively affecting the availability of resources for others (e.g., trolling, spamming, posting flame-bait, or derailing topics).

8. INTELLECTUAL PROPERTY AND USER-GENERATED CONTENT

8.1 Company Ownership: All rights, title, and intellectual property in the Service (including code, themes, characters, lore, dialogues, artwork, sounds, virtual items, and the XIMERIN currency) are exclusively owned by Regnum Games Inc.

8.2 User-Licensed Content: By posting content on our website, official community channels, or in-game chat, you grant the Company a non-exclusive, perpetual, worldwide, royalty-free license to use, reproduce, modify, publish, and display such content in any media, including for advertising purposes. For the avoidance of doubt, the Company?s use of content you post on third-party platforms (like Discord or Reddit) is also subject to the terms of service of those respective platforms. Our legacy Forums are maintained solely as a read-only archive; no new content may be submitted there.

9. DMCA AND COPYRIGHT INFRINGEMENT PROCEDURE

If you believe that your intellectual property rights have been violated by content hosted on our Service, please provide our designated Copyright Agent with the following information in writing (pursuant to 17 U.S.C. § 512(c)):

1. A physical or electronic signature of the IP owner or authorized agent;
2. Identification of the copyrighted work claimed to have been infringed;
3. Identification of the material that is claimed to be infringing and its specific location on the Service;
4. Your contact information (name, address, telephone, email);
5. A statement that you have a good faith belief that use of the material is not authorized by the copyright owner; and
6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner.

10. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

10.1 "As-Is" Provision and Expected Interruptions: THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS AVAILABLE" BASIS. You acknowledge that Champions of Regnum is an actively evolving live-service game managed by a small development team. As such, you agree that frequent bugs, launch issues, emergency maintenance, data rollbacks, and extended downtime are expected aspects of the Service. THE COMPANY DOES NOT GUARANTEE CONTINUOUS, ERROR-FREE, OR SECURE ACCESS TO THE GAME OR WEBSITE. We reserve the right to interrupt, modify, or suspend access for maintenance, updates, or technical fixes at any time without prior notice or liability. No refunds or compensation will be provided for game downtime or interruptions.

10.2 Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, REGNUM GAMES INC. SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR MATERIAL DAMAGES, INCLUDING LOSS OF DATA, REPOSITION COSTS, OR LOSS OF EARNINGS ARISING FROM THE USE OR INABILITY TO USE THE SERVICE.

10.3 Forward-Looking Statements and Developer Communications: Any discussions, roadmaps, or statements made by our developers, staff, or community managers (whether in-game, on Discord, on social media, or elsewhere) regarding upcoming features, potential updates, or future content are strictly for informational purposes. They do not constitute a binding promise, guarantee, or contractual obligation. The development of the Service is subject to change, delay, or cancellation at our sole discretion.

11. TERMINATION OF SERVICE

11.1 By the User: You may cancel your registration at any time. Upon deletion, personal data will be treated in accordance with our Privacy Policy. However, content you have shared publicly may remain visible.

11.2 By the Company: Regnum Games Inc. reserves the right to suspend or permanently close any Account involved in fraud, unauthorized payments, cheating, exploitation of bugs, harassment, or other serious violations of these Terms, at its sole discretion. If we close your Account, we may prevent access to all game content associated with it. Any refunds related to a closed Account will be handled strictly in accordance with our Refund Policy and applicable law; however, account closure does not automatically make every purchase refundable.

12. GOVERNING LAW, JURISDICTION, AND ARBITRATION

12.1 Applicable Law: These Terms, and any dispute arising from them, shall be governed by the laws of the State of Wyoming, USA, without regard to conflict of law provisions.

12.2 Binding Arbitration and Class Action Waiver: ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS SHALL BE RESOLVED BY BINDING ARBITRATION ADMINISTERED IN THE STATE OF WYOMING. YOU AND REGNUM GAMES INC. AGREE THAT CLAIMS MAY ONLY BE BROUGHT IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

12.3 European Union Users: If you are a resident of the European Union, nothing in these Terms shall deprive you of the protection afforded by mandatory statutory consumer protection laws of your country of residence.

2. AGE RESTRICTIONS AND CHILDREN'S PRIVACY

3. INFORMATION WE COLLECT

We only collect information necessary to provide and improve the Service, and to fulfill our legal obligations.

3.1 Information You Provide to Us:

• Account Data: Email address, username, date of birth, password, and real name (if provided).
• Transaction Data: When purchasing virtual currency (XIMERIN), you provide billing information. Note: We use third-party payment processors (e.g., Stripe, PayPal, Xsolla, Apple, Google). We do not collect or store your full credit card number or bank details on our servers.
• Support/Communication Data: Information you provide when submitting a support ticket, emailing us, or interacting directly with our official social media accounts or our official, company-operated community channels (e.g., the official Champions of Regnum Discord server). We do not collect data from unofficial, fan-created, or third-party operated community spaces.

3.2 Information Collected Automatically:

• Technical Data: IP address, MAC address, browser type, operating system, RAM, video card specs, and device identifiers.
• Usage and Game Logs: In-game telemetry, character progression, chat logs, IP logs, match data, and interactions with in-game features.
• Cookies and Tracking Technologies: We use cookies, web beacons, and similar technologies on our website to track user activity, remember login sessions, and optimize your web experience. You can control cookie preferences through your browser settings.

4. HOW WE USE YOUR INFORMATION AND LEGAL BASIS

Under the GDPR and similar laws, we process your data under the following legal bases:

• To Perform our Contract with You: Registering your account, facilitating gameplay, processing XIMERIN purchases, and providing customer support.
• For our Legitimate Interests: Monitoring server stability, anti-cheat enforcement, debugging game crashes, analyzing demographic data to improve the game, and enforcing our Terms of Service.
• With Your Consent: Sending promotional emails and newsletters. You may withdraw this consent at any time.
• To Comply with Legal Obligations: Maintaining financial records for tax purposes and responding to lawful requests from law enforcement.

5. HOW WE SHARE YOUR INFORMATION

We do not "sell" your personal data to third parties as defined by the CCPA. We only share information in the following circumstances:

• Service Providers: We share data with trusted third parties who perform services on our behalf (e.g., Google Cloud for hosting, Zendesk for customer support, Stripe/Xsolla for payments). They are bound by strict data processing agreements.
• Public Information: Your character name, avatar, and clan affiliation are visible to the public in-game. Any information you disclose in public in-game chat or forums is public. We are not responsible for how other players use this information.
• Legal Compliance and Safety: We may disclose your information to law enforcement or government bodies if required by law, to investigate fraud (including chargeback abuse), to enforce our Terms of Service, or to protect the safety and rights of Regnum Games Inc. and our users.
• Business Transfers: If we undergo a merger, acquisition, or sale of assets, your data may be transferred to the succeeding entity.

6. INTERNATIONAL DATA TRANSFERS

Regnum Games Inc. is located in the United States. If you play from the European Economic Area (EEA), the United Kingdom, Switzerland, or other regions with laws governing data collection, please note that your personal data will be transferred to, processed, and stored in the United States. We implement appropriate safeguards, such as Standard Contractual Clauses (SCCs), to ensure your data receives an adequate level of protection when transferred internationally.

9. THIRD-PARTY PLATFORMS AND SOCIAL MEDIA

The Service integrates with, or links to, third-party platforms (e.g., Discord, Reddit, Facebook, Instagram, Bluesky, etc.) for community engagement and communications. Our legacy web forums are maintained strictly as a read-only archive.

When you interact with our official presence on these third-party platforms:

• Your interactions and the data you share are primarily governed by the privacy policies and terms of service of those respective third-party platforms.
• We may collect your public profile information (such as your Discord ID or social media handle) and the contents of your communications with us to moderate our communities, provide customer support, and enforce our Terms of Service.
• If you wish to exercise your privacy rights (such as the Right to Erasure) regarding data hosted on third-party servers, you must submit those requests directly to the respective third-party platform. We are not responsible for the privacy practices of these third parties.

10. CHANGES TO THIS POLICY

Your continued use of the Service after the effective date constitutes your acceptance of the revised Policy.
